Terms of Service

These Terms of Service ("Terms") govern your access to and use of PropertyDeepDive (the "Service"), operated at propertydeepdive.com. By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

PropertyDeepDive aggregates publicly available property records from government open-data sources (including NYC Open Data, NYS Assessment Roll, NJ MOD-IV, NC OneMap, CA state GIS, and others) and provides tools for searching, viewing, and analyzing that data. The Service is provided for informational purposes only and is not a substitute for professional advice or an official record search.

2. Accounts

You must provide accurate information when you create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 13 years old to use the Service.

3. Subscriptions and Billing

• Pro Monthly: $4.99 per month, billed monthly in advance, auto-renews until cancelled.
• Pro Quarterly: $9.99 per three months, billed every three months in advance, auto-renews until cancelled.
• Payments are processed by Stripe, Inc. By subscribing, you authorize recurring charges to your payment method on each renewal date.
• You can cancel at any time from your account or by emailing us. On cancellation, Pro access continues until the end of the current billing period; we do not prorate refunds for partial periods.
• Prices may change. We will provide notice of any price change at least 14 days before it takes effect; continued use after the effective date constitutes acceptance.

4. Refunds

Paid fees are generally non-refundable. If you believe you were charged in error, email [email protected] within 14 days of the charge and we will review your request in good faith.

5. Usage Limits and Tiers

• Free: 5 property lookups per day, access to overview, building, zoning, tax, and map data.
• Pro: 100 lookups per day, plus ownership, deeds, sales, permits, violations, and other premium data.
• We may adjust limits or feature availability with notice. Limits reset daily at midnight UTC.

6. Acceptable Use

You agree not to:

• Scrape, crawl, or bulk-download data from the Service, or circumvent rate limits or tier restrictions.
• Resell, sublicense, or redistribute data obtained from the Service without written permission.
• Use the Service to harass, stalk, or harm any individual, or to violate any law.
• Reverse-engineer, decompile, or interfere with the Service or its infrastructure.
• Use the Service for credit, employment, insurance, housing, or other decisions covered by the Fair Credit Reporting Act (FCRA) or similar laws. The Service is not a consumer reporting agency.

7. Data Accuracy and Disclaimer

Property records are sourced from third-party government datasets and may be incomplete, out of date, or inaccurate. We make no guarantee about the accuracy, completeness, or timeliness of any data. Always verify critical information with the original source before relying on it for any decision.

8. Intellectual Property

The Service, including its software, design, and aggregated presentation of data, is owned by PropertyDeepDive and protected by copyright, trademark, and other laws. Underlying property records are public data owned by their respective agencies. You receive a limited, non-exclusive, non-transferable license to use the Service for your own lawful, non-commercial property research, subject to these Terms.

9. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or for any reason at our reasonable discretion. On termination, your right to use the Service ends immediately.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERTYDEEPDIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold PropertyDeepDive harmless from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Service.

13. Changes to the Terms

We may modify these Terms from time to time. Material changes will be posted to this page with an updated "Last updated" date and, where required by law, notified to you by email. Continued use after the effective date constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.
